We understand that privacy is important to you. We take your privacy very seriously too.  Please read through our Privacy Policy, so you can be confident that your personal information is secure with us.
 

At Smartvisit we take your privacy very seriously. We comply with the General Data Protection Regulation, also known as GDPR, and in accordance with any county-specific regulations applicable to Smartvisit.

In this Privacy Policy, we explain what data we collect from you, why we collect it, how we use it and with whom we might share it. It also explains what rights you as a data subject have and how you can fulfill them.

This Privacy Policy applies to any data processing done by us when using our services, both through our website and through our app.

Who are we and how can you contact us?

We, as the Data Controller, are Smartvisit International Pty Ltd, ABN 47 148 173 719, P.O. Box 1343; Macquarie Park NSW 2113, Australia or such other company in the Smartvisit family that is responsible for processing your personal data, as notified to you. What personal information do we collect?

 We collect the following type of information:
 

  • Personal information collected from customers includes name, address, contact details, payment details, products purchased, IP addresses, geolocation information of app users when tickets are redeemed, product usage, and information you may provide so we can help you decide which of our products or services would best suit your requirements;

  • Personal information collected from business contacts includes name, business position, and business telephone and fax numbers and email addresses;

  • Personal information collected from our employees and contractors includes all information required for the employment or contractual relationship;
     

Generally, all personal information is collected directly from you, or with your consent, and our policy is to collect only personal information that we need for a particular purpose. We do not collect personal information that we do not need.  You are not obliged to provide us with any personal information but if you do not provide us with certain information, we may not be able to provide our products or services to you.

Smartvisit collects personal information in order to provide our customers with our products or services, and in order to manage our relationship with our customers and with the people we do business with. Smartvisit also records product usage data to keep a record of the visits to attractions.

We will not collect sensitive information about you (such as details of your race, political beliefs, religion, or health) without your consent.

What other information is collected?

Smartvisit automatically collects statistical and other information about all visitors to our website and uses of our app.  Please see Online Privacy below for more information about this.
 

How is personal information used?
 

 The personal information collected by Smartvisit is used for our general commercial purposes, including:
 

  1. Where necessary for the performance of the contract between you and Smartvisit (or to take steps at your request to enter into a contract with you):

  • to provide our customers with the products and/or services they have purchased;

  • to collect payment for products and/or services that customers have purchased;

  • to communicate with customers about the products or services they have purchased; and/or

  • to exercise any other right, or fulfill any obligation, under a contract with our customers.

 2. Where necessary in our legitimate interests (or the legitimate interests of a third party) where such       interest is not outweighed by your rights and freedoms:

  • to notify our customers about existing or new Smartvisit products or services or promotions from time to time (where they have not opted-out of receiving such notifications);

  • to help grow our business and improve our Site and app; and

  • to understand and analyze the usage trends and preferences of our users, to improve, and to develop new products, services, features, and functionality.

 3. Where necessary to comply with our legal obligations.
 

 4. To notify our customers about existing or new products or services or promotions offered by one of   Smartvisit’s business partners (with your consent where required).
 

How long will personal information be held?

 Your personal details obtained from purchasing our products will only be kept for 18 months unless:
 

  • you have opted in to hear from us,

  • you set up a personal profile with us, or

  • you extend the validity of your purchase.
     

We may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.
 

Will Personal Information be given to anyone else?

Smartvisit does not sell, rent or trade personal information to or with third parties except as described in this Privacy Policy.  We may disclose your information when you request, authorize or consent to the disclosure.
 

Completing Transactions

Personal information may be disclosed to third parties in order to help complete a transaction you have requested.  This may include providing information when products are purchased for or redeemed at a third-party event or attraction, and when your payment is processed by our third-party payment processors, postal mail, email and text message providers.
 

Outsourcing

Personal information collected by Smartvisit may be disclosed to third parties to whom Smartvisit contracts out specialized functions (including mailing houses, printing companies and fraud detection and prevention agencies) or to third-parties it partners or contracts within creating, operating and selling products, passes, loyalty programs or credit programs. If Smartvisit does disclose personal information to third-party contractors, partners or outsourcing entities under outsourcing or contracting arrangements, Smartvisit takes steps to ensure that those contractors:
 

  • comply with Smartvisit’s Privacy Policy when they handle your personal information and,

  • are authorized only to use personal information in order to provide the services or to perform the functions required by Smartvisit.
     

Legal obligations and security

We may disclose your information in order to comply with the law, applicable regulations, governmental and quasi-governmental requests, court orders or subpoenas, to enforce our Terms of Use or other agreements, or to protect our rights, property or safety or the rights, property or safety of our users or others (e.g., to a consumer reporting agency for fraud protection), and for security purposes including identity verification, investigations, etc.
 

Business transactions

We may disclose your information in connection with a purchase, merger, financing, transfer or sale of services or assets (e.g., in the event that substantially all of our assets are acquired by another party, customer information may be one of the transferred assets).
 

How to access and control your personal data

 Smartvisit wants you to always be in control of your personal data. To this end, you have certain rights that allow for it. Under certain conditions and depending on your location, you may:
 

  • Gain access to all your data that we use for processing, and even get a copy of it.

  • Request Smartvisit to delete your data to the extent permitted by law.

  • Correct the data that Smartvisit is processing if you think that there are mistakes.

  • Object to processing certain types of data or request that processing is restricted.

  • Receive your personal data in a commonly used and machine-readable format or transmit this data to a different provider.

  • Withdraw your consent to processing at any time (where processing is based on consent).
     

 If at any time you wish to exercise any of these rights or no longer wish to be notified about products or services or promotions offered by Smartvisit or Smartvisit’s business partners, please let us know by contacting privacy@smartvisit.com.  You may also complain to the data protection supervisory authority in your jurisdiction.  We would ask that before submitting such a complaint, you contact Smartvisit to discuss your issue.
 

You may opt-out of receiving promotional communications from us by following the instructions included in each communication. Unsubscribing from promotional emails will not stop us from sending emails about your account or your transactions with us. 
 

When you first visit our website, you will be asked for your consent to place cookies.  You can then choose to delete or block cookies by updating your preferences, or by setting your browser to either reject all cookies or to allow cookies only from selected sites.  If you block cookies performance of the Site may be impaired and certain features may not function at all.  See below for more information on cookies and similar technologies.
 

Is personal information stored safely?

Smartvisit takes reasonable physical, administrative and technical steps to ensure the security of personal information held by it from such risks as loss or unauthorized access, destruction, misuse, modification or disclosure. Our IT systems are password protected and comply with our security standards, and if personal information is held on paper files, it is stored in locked cabinets. Smartvisit only permits your details to be accessed by authorized personnel.  We use reasonable measures to protect information being transmitted over the internet.  However, no method of transmission over the Internet, or method of electronic storage, is 100% secure, and we cannot guarantee its security.
 

You also play a role in protecting your information. Do not share your account access information with anyone and advise us as soon as possible if it is lost or stolen. We will recognise any action or transaction taken using your account access information to be authorized by you.
 

Children’s Privacy

You must be at least 18 years old (or of the age of majority in your jurisdiction) to be eligible to use our services. If you are under the age of 18, please do not submit any information to us.  Our website and app are not designed nor intended to be attractive to use by children under the age of 13 (“Minors”). We do not knowingly collect information from Minors and encourage parents and legal guardians of Minors to supervise them when using our services or giving them access to our app.

This Privacy Policy outlines Smartvisit’s approach to all personal information we handle, whether collected online or offline. However, particular issues that arise in the online environment are noted below.
 

Automatically collected information

We automatically collect information when you visit the website or download or use our app including your IP address, the pages you access, and how your use the website and app. We also may collect other non-personally identifiable information when you visit our website or use the app such as your device address or ID, web browser, device type, the features of the apps you use, the web pages or sites that you visit just before or just after you visit our website, the pages or other content you view or otherwise interact with on the Site, and the dates and times that you visit, access, or use the Site. This information is gathered from all users and may be associated with your personal information and includes what areas our users visit most frequently and what services they access most often. This information helps us develop a better website and app that is more useful and accessible to you.

We use cookies and similar technology to collect aggregate (non-personal) information about website and app usage by all of our visitors and to help us remember you and your preferences when you use our services. We do not currently use technology that recognizes a “do-not-track” signal from your web browser.  Cookies that are not absolutely essential for the website to function are only placed with your consent (which is indicated by your interaction with the cookie banner that is presented to you when you visit our website).

Sometimes our website contains links to other websites, for your convenience and information. When you access a website other than ours, please understand that we are not responsible for the privacy practices of that site. You may wish to review the privacy policies of each site you visit.
 

Other Important Information

Notice to residents of California

Your California Privacy Rights.  California residents with an established business relationship with us are permitted by California law once a year to request information about the manner in which we shared certain categories of information with others for their marketing purposes during the prior calendar year.  We do not share personal information with others for their direct marketing purposes.

California Consumer Privacy Act (CCPA) Currently Smartvisit is not subject to the CCPA or its amendment, the Privacy Rights Act, If, in the future, we become subject to this law we will update this Privacy Policy as appropriate.
 

Notice to residents of Virginia, Colorado, Connecticut and Utah

Currently Smartvisit is not subject to the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Data Privacy Act or the Utah Consumer Privacy Act.  If, in the future, we become subject to any of these laws we will update our Privacy Policy as appropriate.

Notice to residents of Nevada

We do not transfer personal information for monetary consideration.  If you would like to tell us not to sell your information in the future, please email us at privacy@smartvisit.com with your name, postal address, telephone number and email address with “Nevada do not sell” in the subject line.
 

Changes to this Privacy Policy

The Privacy Policy in effect at the time you use our website or app governs how we may use your information. From time to time we may amend this Privacy Policy.  If we modify our Privacy Policy, we will post those changes to the revised Policy and the revised effective date on here.
